1. Acceptance of Terms

By accessing and using YourOwn.Show ("the Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

The Service is available to both consumers and business users. For commercial use, additional agreements may apply.

2. Description of Service

YourOwn.Show is an interactive quiz and challenge show engine that brings entertainment to your TV or laptop. Players use their smartphone as a controller.

3. User Accounts

3.1 Account Types

The following account types are available:

Studio Accounts: For creating and managing your own shows. Requires email address, password, and name. By creating an account, you agree to these Terms and our Privacy Policy.
Players: Join shows via QR code or show code. No account is required. Only a player name and optional avatar are collected.

3.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Age Requirement

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this age requirement.

4. Subscriptions and Payment

4.1 Free Use

Certain features are available free of charge. We reserve the right to modify the scope of free usage at any time.

4.2 Paid Packages

Paid packages (e.g., Home, Private Event, Business Event, Custom) are offered as one-time purchases or subscriptions. By purchasing, you agree to pay the applicable fees according to the pricing plan you select. Current pricing is available on our website.

4.3 Payment Processing

All payments are processed securely through Stripe, our third-party payment processor. By providing payment information, you agree to Stripe's Terms of Service. We do not store your complete credit card information on our servers.

4.4 Billing and Renewal

For subscriptions, billing occurs at the end of each billing period. Subscriptions automatically renew unless cancelled before the renewal date.

4.5 Cancellation

You may cancel your subscription at any time through your account settings or the Stripe Customer Portal. Cancellations take effect at the end of the current billing period. You will retain access to paid features until the end of the paid period. No refunds are provided for partial periods.

4.6 Failed Payments

If a payment fails, we will attempt to charge your payment method again. If payment continues to fail, your subscription may be downgraded and you may lose access to paid features.

4.7 Refunds

We generally do not provide refunds for partial subscription periods or unused features. However, we may consider refund requests on a case-by-case basis for technical issues or billing errors. To request a refund, contact us at hello@tntventures.de within 14 days of the charge. EU consumers have additional rights under consumer protection laws.

5. User Content

5.1 Content Ownership

You retain ownership of any content you upload to the Service, including questions, images, audio and video files, and show configurations. By uploading content, you grant YourOwn.Show a worldwide, non-exclusive, royalty-free license to use, process, store, and display your content for the purpose of providing the Service to you and all of your co-players.

5.2 AI-Generated Content

As between the parties, you own all right, title, and interest in and to any content generated by the Service based on your inputs, including AI-generated questions, moderation texts, and other show content. We claim no ownership rights over your generated content.

Our license to your content includes:

Processing your content through AI systems (OpenAI) to generate show material
Generating images, audio, and text based on your content
Storing and displaying content to players who participate in your shows

5.3 Content Restrictions

You agree not to upload content that:

Violates any law or regulation
Infringes on intellectual property rights
Contains harmful, offensive, or inappropriate material
Contains malware or malicious code
Violates third-party privacy rights

You represent and warrant that you hold all necessary rights, licenses, and permissions to any content you upload.

You agree to indemnify and hold harmless the Service, its affiliates, officers, employees, and partners from any claims, damages, losses, or costs arising from your User Content.

5.4 Content Removal

We reserve the right to remove any content that violates these Terms or that we deem inappropriate at our sole discretion.

6. AI-Generated Content Disclaimer

Our Service uses artificial intelligence (OpenAI) to generate show content, quiz questions, moderation texts, and feedback. AI-generated content may contain errors, inaccuracies, or biases.

You acknowledge that:

AI-generated content is not a substitute for professional advice or expert instruction
You are responsible for reviewing and verifying all AI-generated content before use
We do not guarantee the accuracy, completeness, or reliability of AI-generated content
AI may misinterpret user input or generate inappropriate responses despite safeguards
You should not rely solely on AI-generated content for critical decisions

7. Intellectual Property

The Service, including its software, design, text, graphics, and other content (excluding User Content), is owned by YourOwn.Show / TNT Ventures GmbH and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, or create derivative works of the Service without our express permission.

8. Prohibited Uses

You agree not to:

Use the Service for any illegal purpose
Attempt to gain unauthorized access to the Service
Interfere with or disrupt the Service or servers
Use automated systems (bots, scrapers) to access the Service
Impersonate any person or entity
Collect or harvest personal information from other users
Transmit spam, viruses, or harmful code
Create shows or content that is discriminatory, offensive, or illegal

9. Third-Party Services

The Service relies on third-party platforms and services. Your use of these platforms is subject to their respective terms of service and privacy policies. We are not responsible for any third-party services, their availability, performance, or data practices.

Third-party services we use include:

OpenAI: For AI-powered content generation, moderation, and processing
Stripe: For payment processing and subscription management
Supabase: For data storage and authentication
Vercel: For hosting and serving the application
Google Analytics: For website analytics and usage tracking
Resend: For transactional email delivery

Service interruptions, changes, or discontinuation of any third-party service may affect the availability or functionality of our Service. We will make reasonable efforts to provide alternative solutions but cannot guarantee uninterrupted service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOUROWN.SHOW / TNT VENTURES GMBH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. THIS LIMITATION DOES NOT APPLY TO DAMAGES ARISING FROM INJURY TO LIFE, BODY, OR HEALTH, OR IN CASES OF WILLFUL MISCONDUCT OR GROSS NEGLIGENCE.

12. Indemnification

You agree to indemnify and hold harmless YourOwn.Show, TNT Ventures GmbH, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

13. Termination

13.1 Termination by You

You may terminate your account at any time by cancelling your subscription through the Stripe Customer Portal and contacting us to request account deletion.

13.2 Termination by Us

We may terminate or suspend your access to the Service immediately, without prior notice or liability, if you:

Breach these Terms or our Privacy Policy
Engage in fraudulent, abusive, or illegal activity
Fail to pay subscription fees (after reasonable notice)
Upload prohibited or harmful content
Violate the rights of other users or third parties

13.3 Effect of Termination

Upon termination:

Your right to use the Service will cease immediately
Access to your account, shows, and data will be disabled
Paid subscriptions will not be refunded for remaining time
Your data will be retained or deleted according to our Privacy Policy and applicable law
You remain liable for any outstanding fees or obligations incurred before termination

14. EU Consumer Rights

14.1 Right of Withdrawal (14-Day Cooling-Off Period)

For digital services, you have the right to cancel your subscription within 14 days of purchase without giving a reason. However, if you begin using the Service during the withdrawal period (e.g., creating shows, inviting players), you expressly agree that we may begin performance and you acknowledge that you will lose your right of withdrawal once the Service has been fully performed.

14.2 Unfair Terms

Nothing in these Terms affects your statutory rights as a consumer under EU law. If any provision of these Terms is found to be unfair or unenforceable under EU consumer protection law, it will not apply to you, but the rest of these Terms will remain in effect.

14.3 Dispute Resolution

EU consumers may access the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. For consumers in the EU, mandatory consumer protection laws of your country of residence also apply. The place of jurisdiction for disputes with merchants is Cologne, Germany. For consumers, jurisdiction is determined according to applicable consumer protection laws.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by:

Posting the new Terms on this page and updating the "Last updated" date
For significant changes affecting your rights, sending you an email notification (if we have your email)

Changes to these Terms are effective when posted on this page. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.
